Terms of Service

1. Agreement to Terms
By accessing or using any HostPlex service, including web hosting, VPS, web development, server management, and security services, you agree to these Terms of Service. If you do not agree, you must not use our services.
2. Eligibility and Account Responsibility
You must provide accurate registration information and keep it updated. You are responsible for all actions taken under your account, including by authorized users, contractors, or employees.
3. Services Covered
- Web Hosting: Shared or managed hosting plans with specified resource limits.
- VPS Hosting: Virtualized infrastructure with root/administrator-level control based on selected package.
- Web Development: One-time project-based design and development engagements.
- Server Management: Monitoring, patching, hardening, and support services.
- Server Security: Security tooling, audits, and remediation support.
4. Acceptable Use
You may not use HostPlex services for unlawful activity, malware distribution, phishing, abusive traffic generation, unauthorized access attempts, spam, intellectual property infringement, or any activity that degrades platform performance for other customers.
5. Security Obligations
You are responsible for maintaining account-level security, including strong passwords, credential confidentiality, and secure application practices. HostPlex may suspend compromised services to protect customers and infrastructure.
6. Data, Backups, and Recovery
Unless otherwise stated in your plan, backups are provided on a best-effort basis and are not guaranteed as a sole recovery method. You are responsible for maintaining independent backups of all critical data.
7. Pricing, Billing, and Renewals
Recurring services are billed in advance on the billing cycle shown at checkout. One-time services are billed according to project milestones or agreed invoicing terms. Fees are non-refundable except where required by law or expressly stated in writing. Late payments may result in service suspension or termination.
8. Hosting Resource and Usage Billing
Service allocations are subject to fair-use and technical limits tied to your selected package. Overages, add-ons, and upgrade requirements may apply based on actual usage patterns. Web Hosting services are billed based on the selected hosting plan and average daily visitors in addition to any elected optional services or overage charges.
9. Suspension and Termination
HostPlex may suspend or terminate services for non-payment, abuse, security risk, legal requests, or material violations of these terms. We may, where practical, provide notice and an opportunity to cure before termination.
10. Uptime and Maintenance
HostPlex targets high availability and may publish uptime goals or service levels. Planned maintenance, emergency work, upstream provider disruptions, and force majeure events are excluded from any uptime commitments unless otherwise specified in a written SLA.
11. Intellectual Property
You retain ownership of your content and data. HostPlex retains ownership of all platform software, documentation, systems, and proprietary tooling. For web development projects, ownership transfer terms are defined in the applicable statement of work and invoice status.
12. Third-Party Services
Some services rely on third-party providers (registrars, payment processors, cloud infrastructure, SSL vendors). HostPlex is not liable for failures caused by third-party systems beyond our reasonable control.
13. Limitation of Liability
To the maximum extent permitted by law, HostPlex will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. Total liability for any claim is limited to the fees paid for the affected service during the 3 months preceding the event.
14. Indemnification
You agree to indemnify and hold HostPlex harmless from claims, liabilities, damages, and expenses arising from your use of services, your content, or your violation of these terms or applicable law.
15. Refunds and Chargebacks
Any refund policy applies only as explicitly published for the specific service. Filing an unjustified chargeback may result in immediate service suspension and account review.
16. Changes to Services or Terms
HostPlex may modify services, pricing, or these Terms of Service at any time. Material changes will be posted on this page, and continued use after changes constitutes acceptance.
17. Governing Law
These terms are governed by applicable law in the jurisdiction where HostPlex operates, without regard to conflict-of-law rules, except where mandatory consumer protections apply.
